Acceptance of Terms

By accessing or using Romagram ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of the Platform, including visitors, registered members, and Premium subscribers. If you do not agree to these Terms, please do not use our Platform.

Romagram reserves the right to modify these Terms at any time. We will notify you of significant changes via email or a notice on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

Eligibility

To use Romagram, you must meet the following requirements:

You must be at least 18 years of age. We take underage use seriously and will terminate any account found to belong to a minor.
You must be legally permitted to enter into a binding contract under the laws of your jurisdiction.
You must not have been previously banned or removed from our Platform.
You must not be a convicted sex offender.

By creating an account, you confirm that you meet all eligibility requirements listed above.

Account Registration and Responsibilities

When you create an account on Romagram, you agree to:

Provide accurate, truthful, and complete information during registration and in your profile.
Maintain and promptly update your account information to keep it accurate and current.
Keep your password confidential and not share it with any third party.
Take full responsibility for all activities that occur under your account.
Notify us immediately at support@romagram.com if you suspect unauthorised access to your account.
Create only one account per person. Multiple accounts by the same user are not permitted.

Profile and Content Guidelines

You are solely responsible for the content you post on Romagram. By posting content, you grant Romagram a non-exclusive, royalty-free licence to use, display, and distribute that content within the Platform. You agree that your profile and all content you post will:

Accurately represent you — you must be the person in your profile photos.
Not contain nudity, sexually explicit material, or content of a graphic nature.
Not include content that promotes violence, hate speech, discrimination, or illegal activities.
Not infringe any third-party intellectual property rights, including copyrights and trademarks.
Not contain spam, advertising, or solicitation for commercial purposes.
Not include personal contact information in photos or bios intended to bypass our messaging system.

Romagram reserves the right to remove any content that violates these guidelines without prior notice.

Prohibited Conduct

You agree not to engage in any of the following prohibited activities while using Romagram:

Harassing, threatening, intimidating, stalking, or bullying other users.
Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
Using the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
Attempting to gain unauthorised access to other users' accounts or our systems.
Using automated scripts, bots, scrapers, or other automated means to access or interact with the Platform.
Transmitting viruses, malware, or any other harmful code.
Soliciting money from other users under any pretence (romance scamming).
Using the Platform to solicit, arrange, or promote sex work of any kind.
Collecting or storing personal data of other users without their consent.
Interfering with or disrupting the Platform or servers connected to the Platform.

Violations of these prohibited conduct rules may result in immediate account termination and, where appropriate, referral to law enforcement authorities.

Premium Subscriptions

Romagram offers a Premium subscription that unlocks additional features including unlimited profile views, live chat, WhatsApp contact access, and more. By subscribing to Premium, you agree to the following:

Billing: Premium subscriptions are billed in advance on a Daily, Weekly, or Monthly basis depending on the plan you choose. Payments are processed securely via Paystack.
Automatic Renewal: Subscriptions do not automatically renew. You must purchase a new subscription when your current plan expires.
Refunds: All payments are final. We do not offer refunds for unused subscription periods, except in cases where required by applicable consumer protection law.
Price Changes: We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to future purchases.
Feature Changes: We reserve the right to modify, add, or remove Premium features at any time. We will endeavour to notify users of significant feature changes.

Intellectual Property

All content on the Romagram Platform including but not limited to the logo, design, text, graphics, software, and code is owned by or licensed to Romagram and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without our express written permission.

The Romagram name, logo, and all related marks are trademarks of Romagram. You may not use these marks without prior written consent.

Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Platform, you consent to the practices described in our Privacy Policy.

Safety and Reporting

Romagram is committed to creating a safe environment for all users. If you encounter behaviour that violates these Terms or makes you feel unsafe, please report it immediately. You can:

Report a user directly from their profile page.
Contact our safety team at safety@romagram.com.
Block any user you do not wish to interact with.

We take all reports seriously and will investigate promptly. However, we are not responsible for the conduct of users on or off the Platform. Please exercise caution when meeting someone from Romagram in person and always meet in public places.

Disclaimers

Romagram is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that:

The Platform will be uninterrupted, error-free, or secure.
Any matches or connections made through the Platform will be compatible or suitable for you.
The information provided by other users is accurate, complete, or truthful.

You use the Platform at your own risk. Romagram is a platform for connecting people and is not responsible for any real-world interactions between users.

Limitation of Liability

To the maximum extent permitted by applicable law, Romagram and its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from:

Your use or inability to use the Platform.
Any conduct or content of other users on the Platform.
Unauthorised access to or alteration of your transmissions or data.
Any other matter related to the Platform.

Termination

Romagram reserves the right to suspend or permanently terminate your account at our sole discretion, without notice, if we believe you have:

Violated any provision of these Terms.
Engaged in conduct harmful to other users, third parties, or Romagram.
Provided false or misleading information during registration.
Been involved in any fraudulent or illegal activity through the Platform.

You may also delete your own account at any time through the Platform settings. Upon termination, your right to use the Platform ceases immediately. Some provisions of these Terms will survive termination.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
